Welcome to SellOff.ng, this document contains provisions that applies to the use of this website. We strongly advise that you agree to these Terms and Conditions before registering or transacting on this platform.
Throughout this document, wherever the context so requires, 'You' or 'User' shall mean any human being who has agreed to become a buyer or seller on this Platform by providing personal data while registering here as a User with the use of a device connected to the internet. SellOff.ng allows the User to surf the online store or purchase items without initially registering on the Platform. The term 'We', 'Us', 'Our' shall mean SellOff.ng. By using SellOff.ng, you indicate that you have carefully read through, understand, and accept to abide by our terms and conditions. However, feel free to refrain from using our platform if you do not agree with us. Furthermore, we are liable to review, update, or make changes to this document, do well to read this document periodically to stay abreast of any of such changes.
2. Payment & Pricing
Users of this platform must be at least 18 years old at the point of registration and if younger, must access the website under the supervision of a parent or legal guardian. This section of the Terms and Conditions govern the sales and purchase of goods on this Site; no extrinsic evidence, whether oral or written, will be incorporated.
Usage: Membership on SellOff.ng is free. SellOff.ng does not charge any fee for browsing and buying on this platform.
Commission: The commission on the sale of any product on SellOff.ng is 3%. However, SellOff.ng reserves the right to review its commission policy at any time. In the case where the commission rate is review, we will notify our Esteemed Sellers a month in advance.
New Services: At our discretion, we may need to introduce new services or modify existing ones on SellOff.ng. In such event, without seeking permission from users, SellOff.ng reserves the right to introduce fees for such new services or amend/introduce fees for existing services, as the case may be.
Currency: All fees shall be quoted in Naira (#) except otherwise stated and you are solely responsible for compliance of all laws and policies applicable to the use to the Nigeria currency. However, changes to fees and related policies shall only be effective if it has been implemented by SellOff.ng.
Pricing Information: We are determined to provide the most accurate pricing information on the Site to our users; however, in cases where errors occur, for example, when the price of an item is not correctly displayed on the website, we reserve the right to refuse or cancel any order.
Payment Methods: SellOff.ng offers you multiple payment methods (internet banking, gift card, e-wallet, and more). Whatever your online mode of payment is, be assured that SellOff.ng's trusted payment gateway partners use secure encryption technology to keep your transaction details confidential at all times. SellOff.ng also accepts Credit & Debit Card payments made using Verve, MasterCard and VisaCard. There are NO hidden charges when you make a purchase on SellOff.ng. The prices listed for all the items are regulated and final. You are expected to pay the price exactly stated on the products page; not more, not less.
Delivery: Charges on the delivery of an item is dependent on the seller. Remember that Sellers are more likely to incur a relatively higher shipping cost on low-value items; in such a case, charging a nominal delivery charge helps them offset logistics costs. Please check your order summary to understand the delivery charges for individual products. Delivery times are influenced by product availability, geographic location of the Seller, your shipping destination, and the courier partner's time-to-deliver in your location.
3. Return & Refund Policy
Refund Policy: If you terminate your registration for reasons other than a breach in agreement on our part, we will not refund any money to you. If we terminate your registration on our platform for reasons other than a breach in agreement on your part, we will refund to you within 14 days the balance of any money which you have paid to us (and we have received) which relate to services to be provided (but not yet provided) after the date of termination.
Return Policy: Under this policy, options of exchange, replacement, and/or refund is provided by Sellers to you (the Buyer). The return policy on all products differ, do well to check what policy is offered by a Seller for an item before making purchase. Furthermore, items not eligible for returns has been listed below.
Step 1: Send a complaint to firstname.lastname@example.org, as evidence, include pictures of the product that was delivered to you.
Step 2: Once your claim has been validated, we will provide information on the most suitable means of retrieving the item from you.
Step 3: Track the status of your returned item with the return waybill number we will send to you.
Step 4: Upon our confirmation of the receipt of the item by the Seller, SellOff.ng will notify the Seller to resolve the matter responsibily.
Items not Eligible for Return
a. Products that have been altered from their original state or opened by unauthorized personnel.
b. Products such as Laptops and Mobile Devices that has been passworded by the Buyer.
c. Products with tampered or missing serial Universal Product Code numbers (UPC).
d. Products damaged due to misuse.
e. Jewellery, innerwear, bed sheets, lingerie, and socks.
f. Books and CDs
In the event that an item is mispriced, we may at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation. We shall have the right to refuse or cancel any of such order whether or not the order has been confirmed and you have been debited. In the event that we are unable to provide the services, we will inform you of this as soon as possible.
Possible Reasons for Return
- Change of mind: This applies to unused products in only the Fashion category.
- Wrong item: This applies when a product which is different from what was displayed on the website is delivered to you. The return will be authorized after validation, and once the item is returned, item cost and shipping fee will be refunded.
- Incomplete item: This applies when a product delivered is incomplete compared to what was displayed on the website. A return will be authorized after validation only if the item cannot be completed. Once the item is returned, the item cost and shipping fee will be refunded.
- Defective items: After validation, return will be authorized if the delivered product has manufacturers’ defects or wasn't functional when delivered
- Damaged (in transit): When a product has visible damage, return will be authorized after validation. The complaint must be laid within 24 hours of receiving such item.
- Product standard: A product delivered that does not work according to the specification highlighted by the Seller on the website or does not perform specified functions will be returned be authorized after validation.
Please note that after purchase, there should not be an exchange of items, if an item needs to be changed, it should be returned and a fresh order made.
Events Outside Our Control
We will not be liable or responsible for any matter arising from or in connection with events outside our control, including and not limited to: strikes, lock-outs, or other industrial action, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport, impossibility of the use of public or private telecommunications networks. Our obligations shall be suspended for the period that the Force Majeure Event continues, and we will extent the time to perform these obligations after that period. We will take reasonable steps to bring the Force Majeure Event to a close or to find a solution by which our obligations under these terms can be performed despite such event(s).
4. Cancellation of Order
Under a situation where SellOff.ng is not able to meet the requirement of the order placed or such order does not comply with SellOff.ng’s policy, or for any other reason, we reserve the right to cancel such order without any explanation for doing so. However, SellOff.ng will ensure that we communication the cancellation of an order to the concerned person in good time and any applicable refund will be made as well.
5. Termination of Contract
Kindly contact us if you need to terminate your registration at any time and for any reason. We reserve the right to check the validity of such request of registration termination. Be aware that with immediate effect, we may terminate your registration at any time if you violate any of our policies or for other reasons by contacting you with your last recognized postal or e-mail address.
SellOff.ng reserves the absolute right to modify, discontinue, temporarily or permanently, any and all portion of our goods and services with or without prior communications. You hereby consent that SellOff.ng will under no circumstance be liable to you or any third party for any modification or discontinuance of availability of goods or services on the website. We have the right to evict a Seller from SellOff.ng if any, or a combination, of the following breaches, are committed:
- Fails to make a product that has been sold on SellOff.ng available for delivery within three (3) business days after it was supposed to be available for delivery.
- Provides fake, inferior, or substandard products that have been sold as genuine.
- Provides used, refurbished, or damaged products that have been sold as new or unused.
- Lists and sells products that has not been authorized for sale by the appropriate regulatory body (including but not limited to the NCC, NAFDAC, etc).
- Fails to meet the Quality Of Service Standards (QoS) as defined in the SellerHQ rating system (details on request).
- Engages in any activity which would be considered illegal under Nigerian law, or engages in any activity that could be considered as fraudulent or misleading.
- Engages in any activity that brings SellOff.ng, or any of SellOff.ng’s partners, or other mall vendors into disrepute.
You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that demands any form of written communication. Assigning or sub-contracting any of your rights or obligations under these Terms and Conditions of Sale to any third party is prohibited unless agreed upon in writing by the seller.
Generally, transactions are conducted smoothly on SellOff.ng. However, there might be some cases where both the Buyers and Sellers may face issues. At SellOff.ng, we have a Dispute Resolution process which helps us resolve disputes between Buyers and Sellers. Whenever there is a disagreement, the Buyer can write to dispute@SellOff.ng, while the Seller can write to email@example.com to raise a dispute. Disputes can be raised at a particular transaction level.
SellOff.ng reserves its right to initiate civil and/or criminal proceedings against a user who, files an invalid and/or false claims or provides false, incomplete, or misleading information. In addition to the legal proceedings as aforesaid, SellOff.ng may at its sole discretion suspend, block, restrict, cancel the Display Name [and related profile] of such user and/or disqualify that user and any related users from availing protection through this program. Any person who, knowingly and with the intent to injure, defraud, or deceive, files a Fraudulent Complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law.
We reserve the right to transfer, assign or sub-contract the benefit of the whole or part of any rights or obligations under these Terms and Conditions of Sale to any third party.
